1) Scope of application
1.1 These General Terms and Conditions (hereinafter referred to as “GTC”) of K+R Reinigungssysteme e.K. (hereinafter referred to as the “Seller”) apply to all contracts for the delivery of goods concluded between a consumer or entrepreneur (hereinafter referred to as the “Customer”) and the Seller with regard to the goods presented in the Seller’s online shop. The inclusion of the Customer’s own terms and conditions is hereby rejected unless otherwise agreed.
1.2 A consumer within the meaning of these GTC is any natural person who enters into a legal transaction for purposes that are predominantly neither attributable to their commercial nor their self-employed professional activity.
1.3 An entrepreneur within the meaning of these GTC is a natural or legal person or a partnership with legal capacity who, when concluding a legal transaction, acts in the exercise of their commercial or self-employed professional activity.
2) Conclusion of contract
2.1 The product descriptions contained in the Seller’s online shop do not constitute binding offers on the part of the Seller, but serve to enable the Customer to submit a binding offer.
2.2 The Customer may submit the offer via the online order form integrated into the Seller’s online shop. By clicking the button that completes the ordering process after placing the selected goods in the virtual shopping cart, the Customer submits a legally binding contractual offer with regard to the goods contained in the shopping cart.
2.3 The Seller may accept the Customer’s offer within five days
– by sending the Customer a written order confirmation or an order confirmation in text form (fax or email), whereby receipt of the confirmation by the Customer is decisive, or
– by delivering the ordered goods to the Customer, whereby receipt of the goods by the Customer is decisive, or
– by requesting payment from the Customer after the order has been placed.
If several of the aforementioned alternatives apply, the contract is concluded at the time when one of these alternatives first occurs. The acceptance period begins on the day following the dispatch of the offer by the Customer and ends at the end of the fifth day following dispatch. If the Seller does not accept the offer within this period, the offer shall be deemed rejected.
2.4 If a payment method offered by PayPal is selected, payment processing is carried out via PayPal (Europe) S.à r.l. et Cie, S.C.A., Luxembourg, in accordance with PayPal’s terms of use. By selecting a PayPal payment method, the Seller already declares acceptance of the Customer’s offer at the time the Customer completes the order.
2.5 The contract text is stored by the Seller after conclusion of the contract and transmitted to the Customer in text form. Further access to the contract text is not provided unless the Customer has created a user account.
2.6 Before submitting a binding order, the Customer may identify and correct input errors using the usual keyboard and mouse functions.
2.7 The contract may be concluded in different languages. The available language options are displayed in the online shop.
2.8 Order processing and contact generally take place via email. The Customer must ensure that the email address provided is correct and that emails can be received.
3) Right of withdrawal
3.1 Consumers are generally entitled to a right of withdrawal.
3.2 Details regarding the right of withdrawal can be found in the Seller’s withdrawal policy.
4) Prices and payment terms
4.1 Unless otherwise stated, the prices indicated are total prices including statutory VAT. Any additional delivery and shipping costs are stated separately.
4.2 The available payment methods are communicated to the Customer in the Seller’s online shop.
4.3 If advance payment by bank transfer is agreed, payment is due immediately upon conclusion of the contract.
4.4 For “Sofortüberweisung”, payment is processed via Klarna Bank AB, Sweden.
4.5 Payments via Stripe are processed by Stripe Payments Europe Ltd., Ireland.
4.6 Payments via Klarna are processed by Klarna Bank AB, Sweden. Further information is available at:

4.7 Credit card payments via Stripe are due immediately upon conclusion of the contract. Stripe may conduct a credit check.
5) Delivery and shipping conditions
5.1 Delivery is made to the address provided by the Customer within the specified delivery area.
5.2 If delivery fails for reasons attributable to the Customer, the Customer shall bear the resulting costs.
5.3 For entrepreneurs, the risk passes upon handover to the carrier. For consumers, risk passes upon delivery, subject to statutory exceptions.
5.4 The Seller reserves the right to withdraw from the contract in case of incorrect or improper self-supply.
5.5 Self-collection is not possible for logistical reasons.
6) Retention of title
The Seller retains ownership of the goods until full payment has been received.
7) Liability for defects (warranty)
Statutory warranty provisions apply unless otherwise stated. Special provisions apply to entrepreneurs.
8) Liability
The Seller is liable without limitation in cases of intent, gross negligence, injury to life, body or health, guarantees, and mandatory statutory liability. Otherwise, liability is limited to foreseeable damages.
9) Applicable law
The law of the Federal Republic of Germany applies, excluding international sales law. Mandatory consumer protection provisions remain unaffected.
10) Place of jurisdiction
If the Customer is a merchant, the Seller’s place of business shall be the exclusive place of jurisdiction.
11) Alternative dispute resolution
The Seller is neither obliged nor willing to participate in dispute resolution proceedings before a consumer arbitration board.
